2. Privacy policy

2.1 Who is responsible

The controller for personal data processed on this website is Bessen International LLC (see section 1). For any privacy question or request, email it-solutions@bessnetic.com.

2.2 The short version

• This website sets no cookies and uses no analytics, tracking pixels, ads or social media plugins.
• Fonts and all other assets are served from this website itself. Your browser does not contact Google Fonts or other third-party servers while you browse.
• We only receive personal data that you choose to send us through the brief form or by email.
• We do not sell or share your personal information.

2.3 Hosting and server logs

This website is hosted by Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, United States. When you visit a page, Vercel automatically processes technical data needed to deliver it and keep it secure: IP address, date and time, the page requested, referrer, browser and operating system. This data is used only for delivery, security and error analysis, and is kept for a short period in line with Vercel's retention settings.

2.4 Brief form

When you send the brief form, we receive the data you enter: name, agency or studio, work email, type of project, deadline, link to a design or brief, whether you want a callback and, if so, phone number and preferred call time, and your message.

The form is delivered to our inbox by Web3Forms, a form-to-email service. Your entries are transmitted to Web3Forms' servers and forwarded to us by email. More information: Web3Forms privacy policy.

We use this data only to answer your request, prepare a quote and, if you want one, call you back. Legal basis: steps taken at your request before entering into a contract (Art. 6(1)(b) GDPR) and our legitimate interest in responding to business inquiries (Art. 6(1)(f) GDPR).

2.5 Email

If you email us, we process your email address and the content of your message to reply. Legal basis as in 2.4.

2.6 International transfers

We are a US company, and our service providers process data in the United States. If you are in the EU, EEA, UK or Switzerland, your data is therefore transferred to the US. Where available, these transfers rely on the EU-U.S. Data Privacy Framework (and its UK and Swiss extensions) or on the European Commission's Standard Contractual Clauses.

2.7 How long we keep data

Inquiries that don't lead to a project are deleted no later than 24 months after our last contact. If we work together, project and billing records are kept as long as required by applicable tax and commercial law.

2.8 Your rights

Depending on where you live, you have the right to access your data, have it corrected or deleted, restrict or object to its processing, and receive it in a portable format. Where processing is based on consent, you can withdraw it at any time. Email it-solutions@bessnetic.com and we'll respond within one month.

If you are in the EU or EEA, you can also lodge a complaint with the data protection authority in your country. In Switzerland, that's the Federal Data Protection and Information Commissioner (FDPIC).

2.9 US state privacy laws

We do not sell or share personal information, and we do not use it for targeted advertising or profiling. Residents of California and other US states with privacy laws can exercise their rights by emailing us at the address above.

3. Terms of service

3.1 Scope

These terms govern your use of www.bessnetic.com. Project work is governed by the individual written agreement (proposal, statement of work or contract) between your company and Bessen International LLC. If anything in these terms conflicts with that agreement, the agreement prevails.

3.2 Business customers only

Our services are offered exclusively to businesses: agencies, design studios and freelancers acting in a professional capacity. We do not contract with consumers.

3.3 Prices and quotes

Prices on this website are starting prices and do not constitute a binding offer. A binding price, scope and launch date are set only in our written quote once you accept it. Unless agreed otherwise, invoices are issued in USD, in EUR for clients in the euro area, and in EUR or USD for clients in Switzerland. Taxes, where applicable, are added.

3.4 Payment

Unless agreed otherwise, 50% of the project price is due at kickoff and 50% at launch. Care plans are billed monthly and can be cancelled with 30 days' notice.

3.5 Money-back guarantee

Before work starts, scope, designs and features are agreed in writing and acknowledged by you. If the finished work does not match what was agreed and we cannot put it right, you receive a refund of the amounts paid for that project. The detailed conditions are set out in the project agreement. The guarantee does not cover changes in scope, delays caused by missing content or feedback, or third-party services and scripts outside our control.

3.6 Ownership

Once an invoice has been paid in full, all rights to the code and deliverables created for that project transfer to you, as set out in the project agreement. Third-party components (open-source libraries, fonts, plugins, hosted services) remain subject to their own licenses.

3.7 Confidentiality and white-label

A mutual NDA and non-solicitation agreement can be signed before you share any client details. We do not contact your clients unless you ask us to.

3.8 Use of this website

Content, design and code of this website belong to Bessen International LLC. You may not copy or reuse them without permission. Don't misuse the brief form, for example by sending spam or malicious content.

3.9 Liability

This website is provided "as is". To the extent permitted by law, we are not liable for damages arising from its use or from information on it. Liability for project work is governed by the project agreement. Nothing in these terms limits liability that cannot be limited by law, such as liability for intent or gross negligence.

3.10 Governing law

These terms are governed by the laws of the State of Montana, United States, unless the project agreement provides otherwise. Mandatory provisions of the law of your country remain unaffected.

Information on this website about SEO, AEO, GEO, accessibility (WCAG), data protection or security is general information, not legal, compliance or other professional advice. Accessibility to WCAG 2.2 AA is applied where applicable and depends on the approved designs, the content supplied and any third-party components.
